Welcome to Hellohrm, a SaaS-based Human Resource Management System (HRMS) provided by CodersBucket Ltd (referred to as “Hellohrm,” “we,” “us,” or “our”). These Terms of Services (“Terms”) govern your use of the services provided by Hellohrm. By accessing or using the Hellohrm platform or any of its services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use Hellohrm.

1. Acceptance of Terms

By using Hellohrm, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or another legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Description of Service

Hellohrm is a cloud-based HRMS software that provides employee management, leave management, worklog management, task management and other related services. Your use of Hellohrm is subject to these Terms and any additional terms and conditions that may be provided to you by Hellohrm.

3. Use of Hellohrm

3.1. Registration: To access Hellohrm, you must create a user account. You agree to provide accurate and up-to-date information during the registration process.

3.2. Security: You are responsible for maintaining the confidentiality of your account login information and are solely responsible for all activities that occur under your account.

3.3. Access Control: You must not share your account credentials with others, and you are responsible for any unauthorized access or use of your account. Hellohrm is not liable for any loss or damage arising from your failure to comply with these security obligations.

3.4. Content: You are responsible for all content and data you upload, submit, or transmit through Hellohrm. You are responsible for compliance with all applicable laws and regulations when using our services. You agree not to use our services in a manner that infringes upon the rights of others or violates their privacy.

3.5. Purpose: You may use Hellohrm only for its intended purpose, which includes human resource management and related administrative functions. You agree not to use our Service for any illegal, unethical, or unauthorized purpose.

4. Subscription and Payment

4.1. Types of Packages: Hellohrm offers two types of Subscription Packages:

  1. Basic Package: This package is offered free of charge but comes with certain limitations, which include:
    1. A maximum limit on the number of employees/users for the organization.
    2. Inability to integrate third-party applications.
    3. Availability of only ‘Casual Leaves’ for the employees.
  2. Premium Package: Registered organizations opting for the Premium Package will be charged $1 per user per month. This package offers users unrestricted access without any limitations.

4.2. Package Assignment and Free Trial

  1. When a user registers with Hellohrm, their organization will be automatically assigned the Premium Package by default.
  2. The Premium Package will be provided on a free trial basis for a duration of 2 months, as determined by Hellohrm.

4.3. Changing Subscription Packages

  1. Users have the flexibility to change their subscription package from the Subscription Page.
  2. If a user switches from Premium to Basic, the new package will take effect after the current package expires.
  3. If a user upgrades from Basic to Premium, the change will be effective immediately, and the invoice will be generated based on the current number of users in the organization.
  4. During the Free Trial, if a user switches to the Basic Package, their Premium Package Free Trial will be terminated. Switching back to the Premium Package from Basic will incur charges according to the Premium Package pricing.

4.4. Invoice Generation

  1. Invoices will be generated at the beginning of each subscription period, calculated based on the number of active users in the organization.
  2. No refunds will be issued for users deactivated during the period.
  3. If new users are added to an Organization, surpassing the total number of users covered by the initial payment, an extra charge will be included in the next Invoice. This additional charge will be calculated based on the surplus number of users and the number of days they were active during that subscription period.

4.5. Due Dates and Organization Deactivation

  1. There will be a due date for each invoice which will be generated at the beginning of each subscription period.
  2. Organizations must settle their invoices by the due date to maintain uninterrupted service.
  3. After the last day of payment, if the invoices are still due then the Organization’s account will be deactivated and the users of that Organization will lose access to Hellohrm.
  4. The payment for the Subscription period must be completed by the Organization’s Admin to reactivate the Organization’s account. Alternatively, they can also reactivate it by switching to the Basic Package which is free. In that case, the users of this Organization will lose access to the premium features.

5. Intellectual Property

5.1. Ownership: Hellohrm and its licensors retain all rights, title, and interest in and to Hellohrm, including all software, logos, trademarks, and content. You may not copy, modify, distribute, reverse engineer, or decompile our services thereof.

5.2. User Content: You retain ownership of any content you submit to Hellohrm . By submitting content, you grant Hellohrm a non-exclusive, worldwide, royalty-free, and sub-licensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content.

6. Termination

Hellohrm reserves the right to suspend or terminate your access to Hellohrm at its sole discretion, with or without cause, and without notice.

7. Disclaimers and Limitations of Liability

7.1. No Warranty: Hellohrm is provided “as is” and “as available,” without any warranties of any kind, whether express or implied.

7.2. Limitation of Liability: Hellohrm shall not be liable for any direct, indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.

8. Indemnification

You agree to indemnify, defend, and hold harmless Hellohrm and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service or any violation of these Terms.

9. Changes to Terms

Hellohrm reserves the right to update or modify these Terms at any time without prior notice. We will notify you of any changes by email or by posting a notice on our website. Any changes will be effective immediately upon posting on the Hellohrm website. Your continued use of Hellohrm after the changes constitute your acceptance of the modified Terms.
